The evaluation checks for any problems that may affect the pet during his or her stay. The pre-entry evaluation performed by an ACE Team Member is superficial only and not intended to replace a physical exam performed by your veterinarian or imply medical judgments. ACE Pet Resort then "warranties" the pet's health during their stay and for three days after the pet leaves the Resort, up to $250.00. The warranty does NOT cover the following: • Pre-existing health conditions. ACE Pet Resort reserves the right to request medical history on any pet prior to medical treatment. • Pregnant or nursing females. • Damage done by pets boarded together, at the Owner's request, to each other. • Puppies under 16 weeks of age. • Age related illnesses. • Acts of God. The pre-entry evaluation checks for external parasites (fleas and ticks). Any pet found to have external parasites during the evaluation will be bathed and treated with a topical product (Frontline or Advantage) at the Owner's expense. Yes    No Timid or fearful? Yes    No This is a Contract between ACE Pet Resort and the Pet Owner (hereinafter called "Owner").  1. Owner agrees to pay the rate for boarding in effect on the date pet is checked into the Resort. Owner further agrees to pay all costs and charges for special services requested, and all veterinary costs not covered under the Warranty Program for the pet during the time the said pet is in the care of the Resort.  2. Owner further agrees that the pet shall not leave the Resort until all charges are paid to Resort by Owner.  3. By signing this Contract and leaving this pet with the Resort, Owner certifies to the accuracy of all information given about said pet.  4. Resort shall exercise reasonable care for the pet delivered by the Owner to the Resort for boarding. It is expressly agreed by Owner and Resort that the Resort's liability shall not exceed the lesser of the current chattel value of a pet of the same species or the sum of $300.00 per animal boarded. The Owner further agrees to be solely responsible for any and all acts or behavior of said pet while it is in the care of the Resort.  5. Owner specifically represents that he or she is the sole owner of the pet, free and clear of all liens and encumbrances.  6. Owner specifically represents to the Resort that the pet has not been exposed to rabies or distemper within a thirty day period prior to boarding.  7. All charges incurred by Owner shall be payable upon pick-up of pet, or when billed by the Resort at address listed on contract. The Resort shall have, and is hereby granted, a lien on the pet for any and all unpaid charges resulting from boarding pet at the Resort. The Owner hereby agrees that in the event the boarding charges are not paid when due in accordance with this contract, the Resort may exercise its lien rights upon ten days written notice given by Resort to Owner by certified mail to address shown on contract. Resort my dispose of pet for any and all unpaid charges, at private or public sale, in the sole discretion of the Resort, and Owner specifically waives all statutory or legal rights to the contrary. If such sale shall not secure price adequate to pay such cost of board or other charges delinquent, plus costs of sale, then Owner shall be liable to Resort for the difference. All monies realized by Resort at such sale, over and above the charges due and costs of sale, shall be paid by Resort to Owner.  8. To ensure all of our guest's safety, all pets entering the facility for any service must have proof of vaccine from their veterinarian's office. Pets that are not current on their vaccines must have booster vaccines given at least seven to ten days prior staying at the Resort. Canines must have current Rabies, Distemper, Parvo, and Bordetella vaccines. Felines must have current Rabies and Distemper vaccines. It is highly recommend that all pets be on some form of flea and tick preventative. Any pet that is found to have external parasites upon the pre-entry evaluation will be treated at the Owner's expense. Records faxed in advance to 941-921-4395 are greatly appreciated.  9. ACE Pet Resort reserves the right to refuse admittance to pets lacking proof of vaccines, pets displaying potentially contagious conditions, and/or aggressive behavior. 10. We will administer medication provided by the Owner. All medication must be in its original container with the prescribing veterinarian's label indicating the name of the pet, name of the medication, the dosage and frequency. 11. We provide clean and comfortable bedding for all our guests. You may bring your pets own bedding and toys as long as it is machine washable. We will do our best to return all toys and bedding upon your pet's departure. Please note that some animals destroy their bedding and/or toys when boarding. Due to the volume of bedding/toys, ACE Pet Resort cannot be responsible for lost or damaged toys/bedding. 12. Because we do our best to ensure that your pet has a great visit, any pet staying for five days or more will receive The Classic spa treatment at the owner's expense, prior to the pet checking out. 13. We accept holiday and/or peak season reservations with a credit card guarantee. Seven days or less will require a $25 deposit. Eight days or more will require a $40 deposit. We request 72 hour notice of cancellation during holiday and/or peak season - no shows or reservations cancelled with less than 72 hour notice are subject to forfeiture of deposit. 14. In the event of a medical emergency, we will make every effort to contact the pet's regular veterinarian first, if unavailable, we will contact one of our veterinarians. 15. All rates are per day and begin on the day of arrival. You will not be charged for the last day's stay if you pick up your pet before 11:00 a.m. (excluding Sunday). Any pets picking up after 11:00 a.m. will be charged for that day. All rates are subject to change without notice. 16. This Contract contains the entire agreement between the parties. All terms and conditions of this Contract shall be binding on the heirs, administrators, personal representatives and assigns of the Owner and the Resort. 17. Any controversy or claim arising out of or relating to this contract, or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any party to this contract, shall be settled in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by an arbitrator my be entered in any Court having jurisdiction thereof. The arbitrator shall, as part of his award, determine and award to the prevailing party of the costs of such arbitration and reasonable attorney's fess of the prevailing party. 18. Upon signing the Boarding Agreement and Pre-entry Evaluation Warranty Program, the Owner agrees to abide by and accept ACE Pet Resort's policies and procedures.
